Terms of Service

These Terms govern use of wealthaicontrol.one and services by WealthAIControl Solutions Inc. (« WealthAIControl », « we »), Ontario Corporation # 1008765432, BN 834567890 RC0001. By using our website or subscribing, you agree to these Terms.

1. Description of services

WealthAIControl provides AI-assisted personal finance control software: budget dashboards, spending limit guardrails, AI category rules, savings tracking, bill alerts, and control reports. Services organise and help you understand finances — they are not investment advisory, trading, tax, or legal services.

« Control » means budget and spending organisation — not market timing, trading bots, or AUM wealth management. « Wealth » refers to financial discipline — not portfolio advisory. We are not CIRO/CSA registered as investment dealer, portfolio manager, or financial planner. The .one domain is branding only — no life coaching services.

2. Eligibility

You must be eighteen or older and a Canadian resident. Business accounts require authority to bind the entity. Accurate registration information is required.

3. Account security

You are responsible for credential confidentiality and account activity. Report suspected unauthorised access to [email protected] immediately. We may suspend violating accounts.

4. Billing

Plans billed in CAD monthly or annually. Indicative pricing on Services page; final pricing at checkout. HST (834567890 RT0001) applied where required. Third-party payment processing — no full card storage. Failed payments may lead to suspension after notice.

5. Cancellation

Cancel anytime via account settings or email. Effective end of billing period per Consumer Protection Act 2002. Refunds discretionary for service failures on pro-rata basis. No partial-month refunds for customer-initiated cancellation.

6. AI limitations

AI category control and spending insights may contain errors. Review all outputs before tax, legal, or business reliance. No warranty of AI accuracy or fitness for purpose. We do not provide investment advice, trading signals, guaranteed savings, tax filing, credit repair, or portfolio management.

7. Financial disclaimer

WealthAIControl helps Canadians organise personal and household finances with AI-assisted budgeting and spending controls. We are not a wealth management firm and do not manage investment portfolios or provide securities advice. Financial outcomes depend on your circumstances; we make no guarantee of specific savings or returns. AI insights may contain errors — review before acting. Consult licensed professionals for investment decisions.

8. Acceptable use

Prohibited: illegal use, reverse engineering, malicious uploads, impersonation, unauthorised scraping, promotion of trading schemes or MLM, misrepresenting affiliation. Violations may cause termination without refund.

9. Intellectual property

All content and software owned by WealthAIControl Solutions Inc. Limited non-transferable licence during active subscription for personal or internal business use. No copying or derivatives without permission.

10. Privacy

Subject to our Privacy Policy. You retain data ownership. We process per Privacy Policy with your consent.

11. Third-party services

Integrations governed by third-party terms plus ours. We assist with connectivity issues within our control but are not liable for third-party outages.

12. Limitation of liability

Maximum liability limited to twelve months of fees paid. No liability for indirect or consequential damages including reliance on AI without review. Consumer Protection Act 2002 non-excludable rights preserved.

13. Indemnification

You indemnify WealthAIControl from claims arising from Terms violations, service misuse, or unreviewed AI reliance.

14. Dispute resolution

Ontario law governs. Good-faith negotiation first via [email protected]. Unresolved disputes may proceed to Ontario courts. Ontario residents may pursue Consumer Protection Act remedies.

15. Marketing

Marketing emails require CASL express consent. Unsubscribe anytime. Transactional account emails may continue regardless.

16. Modifications

Material changes with thirty days notice via email or website. Cancel before effective date if you disagree.

17. Severability

Invalid provisions do not affect remaining Terms.

19. Service availability

We strive for continuous platform availability but do not guarantee uninterrupted access. Scheduled maintenance is communicated in advance where possible. Service credits for extended outages may be issued at our discretion per support policy.

20. Data portability

Upon request during an active subscription or within twelve months of cancellation, we provide exports of your transaction data and categorisation history in CSV format. Exports exclude proprietary AI model parameters and internal system metadata.

21. Force majeure

Neither party is liable for delays or failures caused by events beyond reasonable control including natural disasters, government actions, infrastructure failures, or widespread cyber incidents — provided affected parties use reasonable efforts to resume performance.

22. Entire agreement

These Terms together with the Privacy Policy and Cookie Policy constitute the entire agreement regarding website and subscription services, superseding prior oral or written understandings on the same subject matter.

23. Language

These Terms are provided in English (Canadian). In case of translation discrepancies, the English version governs for clients subscribing through wealthaicontrol.one.

24. Brand interpretation clause

WealthAIControl acknowledges that brand terms may suggest regulated services to some readers. For clarity: « Wealth » means financial organisation through budgeting discipline; « Control » means spending and budget oversight tools; « .one » is a domain extension without service scope implications. None of these terms imply CIRO registration, portfolio management authority, or life coaching services.

25. Subscription upgrades and downgrades

Plan changes take effect at the next billing cycle unless otherwise agreed in writing. Downgrades may reduce available features immediately upon cycle start; data exceeding lower-tier limits remains accessible read-only for thirty days to allow export.

26. Referral programmes

We do not operate multi-level marketing, pyramid schemes, or commission structures requiring recruitment of other subscribers. Any future referral discounts will be single-tier with clear disclosure and Competition Act compliant terms.

27. Testimonials and case studies

Client testimonials represent individual experiences without guaranteed replicability. We do not compensate testimonials with undisclosed incentives. Case studies use anonymised data unless explicit written consent names the client.

28. API and integration terms

Future API access, if offered, will be governed by supplemental integration terms prohibiting resale of WealthAIControl data, reverse engineering of AI models, and use of exported data for investment product marketing.

29. Governing language for financial disclaimers

Financial services disclaimers in these Terms, footers, and marketing pages are material components of the agreement. Ambiguity is resolved in favour of the interpretation that WealthAIControl does not provide regulated investment services.

30. Survival

Sections regarding intellectual property, limitation of liability, indemnification, financial disclaimers, and dispute resolution survive subscription termination.

31. Assignment

You may not assign subscription rights without our written consent. We may assign these Terms in connection with merger, acquisition, or sale of assets with notice to active subscribers and continued PIPEDA protection commitments.

32. Waiver

Failure to enforce any Term provision does not constitute waiver of future enforcement. Waivers must be written and signed by authorised WealthAIControl representatives.

33. Electronic communications

You consent to receive service-related communications electronically to the email address on your account. Electronic delivery satisfies legal notice requirements where permitted under Ontario law.

Formal notices under these Terms may be sent to the email address associated with your account or to our registered office address by certified mail. Notices are deemed received one business day after email delivery or five business days after mailing. Subscribers must maintain current contact email addresses for effective notice delivery. Failure to update contact details does not invalidate properly sent notices.
